Information about other people which you provide to us

If you provide personal information to us about someone else you must ensure you are entitled to disclose that information to us without the need for us to take any additional steps in respect to how we use and disclose that information as described in this Privacy Policy. You must also ensure the individual concerned is aware of the details contained in this Privacy Policy and consents to same.

How we collect and hold information

Where it is reasonable and practicable to do so, we collect your personal information from you directly in a number of circumstances, including but not limited to: when you make an enquiry on our websites or over the phone; when you visit one of our display homes or attend an event hosted by us; when you provide feedback/complaints to us; when you register your details with us or any of our related entities; through our social media pages; from third parties including your lawyers, financiers and other authorised representatives; our sales agents; our mortgage brokers and/or financial service providers; or when you apply for employment with us or any of our related entities. Depending on the product or service we provide to you, we may collect your personal information from third parties. Information about suppliers’ employees is usually collected from the supplier. Information about potential employees is usually collected during the recruitment process.

We take all reasonable steps to protect your information from misuse, loss, unauthorised access, modification or disclosure.

What information we may collect and hold about you

Generally, the information we collect and hold about our customers includes your name, address, phone number, credit and billing information, and e-mail addresses. In some instances, we may also collect your ID, such as a driver’s licence. We also collect demographic information, which is not unique to you, such as your postcode, age, gender, interests and your favourite home designs or home and land packages we offer. When you visit our websites, we may also collect information about your computer, including your IP address.

We also collect information about your use of our website using cookies in order for you to fully experience our digital marketing channels and their features.

We may also collect additional information about customers, including purchase history, location and preferences, either directly, or through our business partners.

Why we collect, hold, use and disclose your information

We, our agents, sub-contractors, external contractors (including but not limited to; Campaign Monitor, LivePerson, Kentico CMS and TigerPistol Pty Ltd) and any member of our related entities (including but not limited to National Pacific Finance Pty Ltd), may collect and use your personal information to:

  • Sell, deliver, administer improve and personalise the products and services of National Pacific Finance Pty Ltd (who provide mortgage brokering services);

From time to time, we may also use your personal information to send you text messages or emails to; invite you to complete a review, send you targeted news, offers and promotions of our products and services.   • if you have provided us with your personal information for the purposes of engaging us for our services then we may disclose your personal information to any of our employees, agents, contractors, sub-contractors and to any members of our related entities;
  • we may disclose your personal information to any of our agents, consultants and sub-contractors to assist us in the operation of our business including updating any of our websites, or to provide any business related services to us, and who are subject to strict security and confidentiality obligations;
  • we may disclose your personal information between our related entities on a confidential basis for the purposes of internal administration, billing and other business practices; and
  • we will disclose your personal information if required or permitted by law.
 

Direct marketing

Burbank may disclose your personal information, and you consent to Burbank disclosing your personal information, to its related bodies corporate and associated entities (as those terms are defined in the Corporations Act 2001 (Cth)).

Burbank may also disclose your personal information, and you consent to Burbank disclosing your personal information, to the following third parties:

  • National Pacific Finance Pty Ltd to provide its mortgage brokering services to you
  • Campaign Monitor Pty Ltd to provide exclusive promotions and offers
  • responsible authorities, such as local councils and water authorities
  • builders and their housing consultants
  • the Land Titles Office
  • relevant State and Territory Valuers General
  • real estate agent
  • Australian Securities and Investment Commission
  • financiers and potential financiers
  • financial institutions for payment processing
  • an individual’s agent or authorised representative
  • referees whose details are provided to us by job applicants
  • referees for tenants
  • third parties who support our information technology or handle mailings on our behalf
  • our contracted service providers (including payment processors, our web consultants and Google Analytics). In each case, we may disclose personal information to the service provider and the service provider may in turn provide us with personal information collected from you in the course of providing the relevant products or services;
  • law enforcement agencies, other governmental agencies or third parties if we are required by law to do so, or in other limited circumstances (for example if required by a court order or regulatory authority, or if we believe that such action is necessary to prevent fraud or cyber-crime or to protect our website, our products or our technology assets or the rights, property or personal safety of any person)

How we manage a complaint in relation to our privacy policy

In a situation where a customer believes we have breached the Australian Privacy Principles they must lodge a complaint in writing to our Privacy Officer using the details provided above. Upon receipt of this written complaint we will investigate and follow up with the customer in due course in our efforts to resolve the complaint raised by the customer.

Alternatively, a customer can make a complaint to the Office of the Australian Information Commissioner (“OAIC”) in respect of our handling of your personal information.
